RERA and Escrow: How Dubai Protects Off-Plan Buyers

Dubai’s regulatory framework for off-plan property is more robust than many investors realise, and less complete than some developers imply. Understanding what RERA (Real Estate Regulatory Authority) and the Escrow Law actually do for you is essential before committing to any pre-construction purchase.

What RERA Requires of Developers

RERA issues developer licences and project approvals. No off-plan project can legally be marketed without RERA registration, which requires the developer to demonstrate land ownership or a valid development right, and project approval before sales begin. This establishes a meaningful baseline: completely fraudulent launches without any underlying asset are effectively eliminated. It does not, however, guarantee that a legitimate project will be completed on time or at all.

How Escrow Works

The Escrow Law (Law No. 8 of 2007) requires all off-plan sale proceeds to be held in a DLD-registered escrow account, accessible to the developer only in tranches tied to verified construction milestones. In principle, your money can only be released as the building actually progresses.

In practice, the system works as intended for most projects. The limitations: milestone inspections are conducted by approved third-party inspectors whose oversight quality varies. And the law does not prevent delays — it only ensures the funds remain available if construction continues. A project can stall legitimately under escrow protection.

What Happens if a Developer Defaults

RERA can cancel a project if a developer fails to meet its obligations. Registered buyers can receive partial refunds from escrow. In practice, the recovery process is slow and the refund amount depends on how much the developer has drawn from escrow by the time of cancellation. The best protection against developer default is due diligence on the developer — escrow is a backstop, not a guarantee.

The DLD Oqood Registration Step

The Sale and Purchase Agreement must be registered with DLD within 60 days of signing. This registration — which produces an Oqood (interim registration) document — is what gives you legal standing as a buyer. Ensure your SPA is registered and you have the Oqood in hand before making further payments beyond the reservation deposit.

The Honest Take

Dubai’s off-plan framework is one of the more developed in the MENA region. Escrow and RERA registration provide real protections. They manage developer risk — they do not eliminate it. The residual risk is best addressed through developer due diligence, not regulatory reliance alone.
